Power of Attorney

Afghan nationals residing in Germany can obtain a Power of Attorney (Wakalatnama / وکالت خط) at this Consulate General. This document authorizes another person to act on your behalf in legal, property, family, or other matters in Afghanistan or other countries.

What is a Power of Attorney?:
A Power of Attorney (Wakalatnama) is an official legal document by which a person (the client) authorizes another person (the attorney) to carry out specific legal transactions on their behalf. The attorney can be granted authority for matters such as property sales, inheritance proceedings, marriage registration, legal representation in court, financial management, and other legal affairs. The scope of the attorney's authority must be clearly defined in the document.
Important Information:
The applicant, along with two witnesses who are adult Afghan citizens, must visit the Consulate General in person. This document cannot be processed via post or online.

An appointment must be booked in advance through the official online system. Visiting the Consulate General without an appointment is not permitted.

Applications are accepted only during official working hours: Monday to Thursday, 9:00 – 14:00.

Required Documents

The application form must be completed carefully and accurately in Dari or Pashto. Special attention must be paid to names, dates, figures, and places. The form must clearly specify the subject of the Power of Attorney and define the exact scope and limits of the attorney's authority.
The applicant and two witnesses must provide their original Afghan Tazkira, e-Tazkira, or valid Afghan Passport, along with copies.
The applicant and two witnesses must provide a copy of their Aufenthaltstitel or Personalausweis — both sides, clearly showing name and address.
The applicant and two witnesses must each provide two recently taken passport-size photos with a plain white background.
A copy of the Tazkira or Passport and a recent photo of the person being granted the Power of Attorney (the attorney or legal representative) in Afghanistan or another country must be provided.
Two adult Afghan citizen witnesses must be present in person. They must personally attest that they know the applicant and are familiar with the purpose of the Power of Attorney. Witnesses must be sane, adult, legally competent, and must not be among those who will directly benefit from the Power of Attorney.
This type of Power of Attorney is for cases where one spouse is unable to be physically present at the Consulate General for the Marriage Certificate registration. Either the husband or wife residing in Germany must attend in person.
The application form must be completed carefully and accurately in Dari or Pashto. Special attention must be paid to names, dates, figures, and places. The form must clearly specify the subject of the Power of Attorney and define the exact scope and limits of the attorney's authority.
A formal written request letter must be submitted, specifying the required services and including details about the date and place of the marriage.
Either the husband or wife (the one attending) and two witnesses must provide their original Afghan Tazkira, e-Tazkira, or Passport along with copies. A copy of the spouse's Tazkira who is not present must also be provided.
The applicant and two witnesses must provide a copy of their Aufenthaltstitel or Personalausweis — both sides, clearly showing name and address.

For property-related matters, the following additional documents must be provided: a copy of the property ownership document (Sale Deed / Qabala) or detailed information about the property. If the property is inherited, a copy of the Hasr-e-Wirasat (Inheritance Certificate) must also be included.

Issuance Process

  1. In-Person Appointment: The applicant and two witnesses must attend the appointment at the Consulate General and present all required documents.
  2. Verification and Interview: The consular officer will verify the documents, confirm the identity of the applicant and witnesses, and review the scope of the Power of Attorney. All information is recorded and signed.
  3. Same-Day Issuance: Once all requirements are met and the fee is paid, the Power of Attorney will be issued on the same day during working hours.

Important Notes

  • Define the scope clearly. The Power of Attorney must clearly state what the attorney is and is not authorized to do. Vague or overly broad powers may not be accepted by Afghan authorities or courts.
  • Legal representation in court. If the Power of Attorney is intended for legal claims or court proceedings in Afghanistan, the designated attorney must either be a licensed lawyer or an immediate family member of the applicant (parent, child, sibling, or relative within the same lineage).
  • Bring complete documents. Please ensure all required documents are brought to your appointment. Applications with missing documents will not be processed.
